Golfy (PTY) LTD

These Sales Terms & Conditions apply to all products, equipment, golf carts, forklifts, utility vehicles, trailers, parts, accessories, and services supplied by Golfy (PTY) LTD.

By purchasing from us, the customer agrees to the following terms and conditions.

1. DEFINITIONS

• “Company”, “we”, “us”, or “our” refers to Golfy (PTY) LTD.

• “Customer” refers to any individual, company, or organization purchasing goods or services from us.

• “Goods” refers to products, vehicles, parts, accessories, or equipment sold by Golfy (PTY) LTD.

• “Services” refers to any repairs, maintenance, delivery, installation, rentals, or related services provided by us.

2. ORDERS & ACCEPTANCE

2.1 All quotations are subject to availability and may change without notice.

2.2 Orders are only confirmed once payment or deposit requirements have been satisfied.

2.3 We reserve the right to refuse or cancel orders where necessary.

2.4 Product images on the website are for illustration purposes and may differ slightly from actual products.

3. PRICING & PAYMENTS

3.1 Prices are listed in South African Rand (ZAR) unless otherwise stated.

3.2 Prices may exclude delivery, installation, taxes, registration fees, or additional services unless specified.

3.3 Full payment or agreed deposits must be made before collection or delivery.

3.4 Late or outstanding payments may result in delays, suspension, or cancellation of services.

4. DELIVERY

4.1 Delivery dates are estimates and may vary due to transport, stock availability, weather, or operational factors.

4.2 Customers are responsible for ensuring safe and suitable access for deliveries.

4.3 Additional charges may apply for difficult access, delays, or failed delivery attempts.

4.4 Risk transfers to the customer upon delivery or collection.

5. OWNERSHIP OF GOODS

5.1 Ownership of goods remains with Golfy (PTY) LTD until full payment has been received and cleared.

5.2 We reserve the right to recover goods where payment obligations are not fulfilled.

6. RETURNS & REFUNDS

6.1 Returns are subject to our Returns & Refunds Policy.

6.2 Returned items must be unused, undamaged, and in original packaging unless faulty.

6.3 Certain items including custom orders, clearance items, or used products may not qualify for returns.

7. WARRANTIES

7.1 Products may include manufacturer warranties where applicable.

7.2 Warranties do not cover:

• Misuse

• Negligence

• Unauthorized modifications

• Improper operation

• Normal wear and tear

7.3 Customers must follow all operating and maintenance guidelines.

8. CUSTOMER RESPONSIBILITIES

Customers agree to:

• Use products safely and correctly

• Follow operational instructions

• Ensure qualified operators where required

• Maintain products appropriately

9. LIMITATION OF LIABILITY

9.1 Golfy (PTY) LTD shall not be liable for indirect, incidental, or consequential damages including loss of profits, business interruption, or operational downtime.

9.2 Our maximum liability shall not exceed the original purchase price of the goods or services supplied.

10. CANCELLATIONS

10.1 Orders may only be cancelled before dispatch or processing.

10.2 Cancellation fees may apply for processed, custom, or special-order items.

11. FORCE MAJEURE

Golfy (PTY) LTD shall not be held responsible for delays or failures caused by circumstances beyond our reasonable control including:

• Natural disasters

• Transport disruptions

• Supplier shortages

• Government restrictions

• Power outages

• Strikes or labor disputes

12. INTELLECTUAL PROPERTY

All website content, logos, branding, product descriptions, images, and materials remain the property of Golfy (PTY) LTD unless otherwise stated.

13. GOVERNING LAW

These Terms & Conditions are governed by the laws of South Africa.

14. POLICY CHANGES

Golfy (PTY) LTD reserves the right to update or modify these Terms & Conditions at any time without prior notice.
